Terms of Service

These terms are an agreement between you and the maker of PicSir ("we", "us"), named under Contact below. By using PicSir Web at picsir.com (the "Service") you accept them. If you do not agree, please do not use the Service. The Android app is governed by the Google Play terms and its own policies, not by this document.

1. What the Service is

PicSir Web is a photo editor that runs in your web browser. Your photos are processed on your device and are not uploaded to us. Some features use an on-device machine-learning model that your browser downloads and runs locally. How we handle data is described in the Privacy Policy, which is part of these terms.

2. Accounts

• You can use the free tools without an account. Premium tools and the trial require signing in with Google or with an email address and password.
• You must be at least 13 years old, and old enough to enter a contract where you live if you subscribe. You are responsible for keeping your sign-in secure and for what happens under your account.
• One account per person. Creating accounts to obtain repeated free trials is not allowed, and we may resume rather than restart a trial for an email that has already used one.
• You can delete your account at any time from the Account page. Deletion is permanent and is described in the Privacy Policy.

3. Free tier and free trial

• Adjust, Crop, Heal and Export are free indefinitely. Exports made without a subscription carry a PicSir watermark.
• Signing in starts a free trial of every tool that lasts 48 hours from your first sign-in. No payment method is required. The trial is offered once per person and ends automatically; nothing is charged when it ends.
• Premium tools may be previewed without a subscription. Applying, saving or exporting their results requires an active trial or subscription. We may change what the free tier includes with notice on this page.

4. Subscription, renewal and price

• Price. PicSir Web Premium costs $7.99 per month. On the first month of any new subscription an additional one-time charge of $2.00 applies, so your first payment is $9.99 and each later monthly payment is $7.99, plus any applicable tax.
• Automatic renewal. The subscription renews automatically every month and your payment method is charged $7.99 at the start of each monthly period until you cancel. You will be shown the recurring amount before you confirm the first payment.
• Payment. Payments are processed by Stripe under its own terms. We do not see or store your card details. If a renewal payment fails, Stripe will retry and email you; if payment cannot be collected, your subscription ends and Premium features lock.
• Price changes. We may change the price for future periods with at least 30 days' notice by email and on this page. The change applies from your next renewal after the notice period; you may cancel before then.
• Separate from Android. This subscription unlocks the web Service only. It does not unlock the Android app, and a Google Play purchase does not unlock the web Service.

5. Cancelling

• Cancel at any time from your Account page ("Manage billing on Stripe", which opens the Stripe customer portal), or by emailing us. Cancelling takes effect at the end of the period you have already paid for; you keep Premium until then and are not charged again.
• Cancelling is never harder than subscribing: no phone call, no retention flow.
• If you subscribe again after a cancellation has taken effect, it is a new subscription and the first-month charge in section 4 applies again.

6. Refunds

• If you are unhappy with a charge, you can refund it yourself within 14 days from the Account page ("Request a refund"), no questions asked. The refund covers the subscription charge; the one-time $2 first-month fee is not refundable, so a first-month refund returns $7.99 and a renewal refund returns the full $7.99. The self-serve refund is available once per person; it does not reset if you subscribe again or make a new account. You may also email us within the same 14 days, and later requests are at our discretion. Refunding a payment ends the subscription it paid for and locks Premium immediately.
• Charges older than 14 days are not normally refunded, since you keep access for the period you pay for and can cancel at any time. We may still refund at our discretion, for example after a service outage.
• Please contact us before disputing a charge with your bank; a dispute costs us a fee whether or not it succeeds, and we resolve refund requests faster than banks do. A chargeback ends the subscription it was raised against, and while a dispute is open or has been decided against us, new subscriptions on that account or email are paused until you contact support.

7. Your content

• Your photos, edits, stickers and exports are yours. We claim no rights in them. Because they are processed on your device and never sent to us, we cannot see, use or recover them.
• You are responsible for having the right to edit the photos you use and for how you use the results.

8. Acceptable use

Do not use the Service to:

• Create or share images that harass, defame, threaten or deceive a real person, including sexualised images of anyone made without consent and any sexual content involving minors.
• Produce material that infringes someone else's copyright or trademark, or that breaks a law that applies to you.
• Interfere with the Service, bypass the trial or subscription checks, share an account, scrape, or reverse-engineer the on-device model beyond what its open licence permits.

We may suspend or delete an account used in breach of these terms.

9. Availability and changes

We work to keep the Service available but do not guarantee it will be uninterrupted or error-free. We may add, change or remove features. If we discontinue the Service, we will give subscribers at least 30 days' notice and refund any prepaid period that would go unused.

10. Disclaimer of warranties

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. The tools, including the machine-learning features, are creative aids and may produce unexpected results; keep copies of your original photos.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data or profits, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. Some jurisdictions do not allow these limitations, in which case they apply to the extent permitted.

12. Governing law and disputes

These terms are governed by the laws of the State of Indiana, USA, without regard to its conflict-of-law rules. Any dispute that cannot be resolved by contacting us will be brought in the state or federal courts located in Indiana, and you consent to their jurisdiction. If you are a consumer in a jurisdiction whose law gives you mandatory protections, nothing here removes them.

13. Changes to these terms

We may update these terms. Changes are posted here with a new effective date; for material changes that affect subscribers we will also email you at least 14 days before they take effect. Continuing to use the Service after that date means you accept the updated terms.
